§ 4. Technical Requirements
To use the Store, including browsing its assortment and placing Orders for Products, the following are required:
- An end device with Internet access and a web browser compatible with the Shopify technology that powers the EDUstick store;
- An active email account;
- An active phone number;
- Cookies strictly necessary for the Store to work (cart, checkout, login) enabled. Analytics and marketing cookies are not necessary to place an Order; how they are used and how to opt out of them is described in the Privacy Policy (§ 9).
§ 5. General Information
- To the fullest extent permitted by law, the Seller is not liable for any disruptions, including interruptions in the functioning of the Store, caused by force majeure, unlawful actions of third parties, or incompatibility of the online store with the Customer's technical infrastructure.
- Browsing the Store's assortment does not require creating an Account. Customers may place Orders for Products available in the Store either after creating an Account in accordance with § 6 of these Terms, or by providing the necessary personal and address data enabling Order fulfilment without creating an Account.
- Prices in the Store are gross prices (including VAT) and are shown in the currency applicable to the country or market selected by the Customer in the Store (in particular Polish złoty (PLN) for Poland and euro (EUR) for euro-area countries). The currency and price applicable to the Order are shown in the Cart and at checkout before the Order is placed.
- The final amount payable by the Customer consists of the Product price and the delivery cost (including transport, delivery, and postal service fees), of which the Customer is informed on the Store's pages during Order placement, including at the moment of confirming the intention to be bound by the Sales Agreement.
- For Agreements covering subscriptions or services for an indefinite period, the final price is the total price covering all payments for the billing period. The rules of the Creators Club Subscription are set out in § 9a.
- Where the nature of the subject of the Agreement does not reasonably allow the final price to be calculated in advance, information on how the price will be calculated, as well as on transport, delivery, postal, and other costs, will be provided in the Store in the Product description.
- Materials prepared using artificial intelligence. The Seller may prepare materials published in the Store and on the Website — in particular illustrative photos, graphics, texts, activity scenarios and videos — using artificial intelligence tools, without labelling each such material individually. Materials prepared with such tools that depict Products are illustrative only: they do not change the Product description, its features, specifications or the contents of a set, which are defined by the Product description in the Store. Content that must by law be labelled as generated or manipulated by artificial intelligence (in particular deepfakes within the meaning of Article 50 of Regulation (EU) 2024/1689 on artificial intelligence) is labelled by the Seller as required by those provisions. This provision does not limit the Consumer's rights under the rules on conformity of the Product with the contract.
§ 6. Creating an Account in the Store
To create an Account in the Store, complete the Registration Form. An active email address is required; the Customer may also provide their name, phone number and address in the Registration Form or in the Account settings.
- Creating an Account in the Store is free of charge.
- Logging into the Account is done by entering the email address and a one-time code sent to that address.
- The Customer may, at any time, without giving reasons and without any fees, delete their Account by sending a relevant request to the Seller, in particular by email or in writing to the addresses specified in § 3.
§ 7. Placing an Order
To place an Order:
- Log into the Store (optional);
- Select the Product that is the subject of the Order and click "Add to Cart" (or equivalent);
- Log in or use the option to place an Order without registration;
- If placing an Order without registration, complete the Order Form by entering the recipient's data and the address for delivery, select the shipping method, and enter invoicing data if different from the recipient's data;
- Click "Order and pay" (or click "Order and pay" and confirm the order via the link sent by email);
- Select one of the available payment methods and, depending on the chosen method, pay for the order within the specified timeframe, subject to § 9(3).
- For a Creators Club Subscription, the Order includes consent to automatic renewal of the Subscription and to saving the payment method in accordance with § 9a; the Product is not shipped and no delivery method is selected.
§ 8. Delivery and Payment Methods
- The Customer may use the following methods of delivery or collection of the ordered Product, provided they are available for the Product ordered:
- 1) Courier delivery;
- 2) In-person pickup, available at: EDUstick Sp. z o.o., ul. Żegańska 15, 04-713 Warsaw.
- The Customer may use the following payment methods, provided they are available for the Product ordered:
- 1) Cash on delivery;
- 2) Bank transfer to the Seller's account;
- 3) Electronic payments;
- 4) Payment card.
- Card and digital-wallet payments are handled by Shopify Payments — a service of Shopify International Limited (Dublin, Ireland), under which payments are processed by Stripe Payments Europe, Limited (Dublin, Ireland). A Subscription can only be paid using a payment method that supports recurring payments, as shown at checkout.
Detailed information about currently available delivery methods and accepted payment methods is provided on the Store's pages.
§ 9. Performance of the Sales Agreement
- The conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer has placed an Order using the Order Form in the online store, in accordance with § 7 of these Terms.
- After the Order has been placed, the Seller promptly confirms its receipt and simultaneously accepts the Order for fulfilment. Confirmation of receipt of the Order and its acceptance for fulfilment takes place via an email sent by the Seller to the Customer at the email address provided during Order placement, containing at minimum the Seller's statements regarding receipt of the Order, its acceptance for fulfilment, and confirmation of the conclusion of the Sales Agreement. Upon the Customer's receipt of the above email, the Sales Agreement between the Customer and the Seller is concluded.
- In the event the Customer selects:
- 1) Bank transfer, electronic payment, or payment card: the Customer is obliged to make payment within 3 calendar days from the date of conclusion of the Sales Agreement. Otherwise, the order will be cancelled.
- 2) Cash on delivery: the Customer is obliged to make payment upon receipt of the shipment.
- 3) Cash payment upon in-person pickup: the Customer is obliged to make payment upon collection of the shipment within 3 days from the date of receiving notification that the shipment is ready for collection.
- If the Customer selects a delivery method other than in-person pickup, the Product will be shipped by the Seller within the period indicated in its description (subject to paragraph 5 of this section) using the method selected by the Customer when placing the Order.
- If Products with different delivery dates are ordered, the delivery date is the longest of those indicated.
- The delivery period begins:
- 1) For bank transfer, electronic payment, or payment card: from the date the Seller's bank account is credited.
- 2) For cash payment upon in-person pickup: from the date of conclusion of the Sales Agreement.
- If the Customer selects in-person pickup, the Product will be ready for collection within the period indicated in the Product description. The Customer will be additionally notified of the Product's readiness for collection via an email sent to the address provided during Order placement.
- If Products with different pickup-readiness dates are ordered, the Customer may collect the Products in parts (according to their readiness for collection) or collect all Products once the entire Order is complete.
- Delivery of Products takes place in Poland and in the countries listed in the Shipping Policy.
- Delivery of the Product to the Customer is paid, unless the Sales Agreement provides otherwise. Delivery costs (including transport, delivery, and postal service fees) are indicated to the Customer on the Store's pages under "Shipping costs" and during Order placement, including at the moment the Customer confirms the intention to be bound by the Sales Agreement.
- In-person pickup of the Product by the Customer is free of charge.
§ 9a. EDUstick Creators Club — Subscription and Access Codes
- Subject matter. A Creators Club Subscription gives access to Materials on the Website under Full Access for a time corresponding to the paid billing periods. The scope of Materials covered by Full Access and the rules for their use, including the licence, are set out in the Website Terms. The Subscription does not include delivery of goods.
- Periods and prices. The Subscription is concluded for a billing period of 1 month, 3 months or 12 months. The price per billing period is shown on the Product page, in the Cart and at checkout before the Order is placed.
- Member discounts. During a paid Subscription period, the Customer is entitled to a discount of 25% on Magic Filament™ filaments and 15% on EDUstick® accessories purchased in the Store. The discounts are applied using discount codes provided to the Customer together with access to the Creators Club (by email or on the Website), which are entered at the Store checkout. The discount codes are for the Customer only and may not be shared with third parties. The right to the discount ends when the Subscription ends.
- Conclusion of the agreement. The Subscription agreement is concluded in the Store in accordance with § 9(2). No paid agreements are concluded and no payments are accepted on the Website.
- Access Code. For each paid billing period — the first one and each subsequent one paid on renewal — the Seller sends the Customer one Access Code to the email address given in the Order within 24 hours on business days of the payment being credited. The Access Code opens an Access Window for a period equal to the paid billing period, counted from the moment the Code is entered on the Website, or, if an Access Window is already open, extends it by that period. An unused Access Code does not expire.
- Website account. A free account on the Website, created under the Website Terms, is needed to use an Access Code. The Website account is separate from the Store Account.
- Automatic renewal. The Subscription renews automatically for a further billing period of the same length, and the price is charged on the renewal date to the payment method saved with the Subscription. The next renewal date and amount are always shown in the Store Account (“Subscription” section) and in the purchase confirmation email. The Customer may cancel the Subscription at any time before that date (paragraph 8).
- Cancellation. The Customer may cancel the Subscription at any time, without giving reasons and free of charge — in the Store Account, in the subscriptions section, or by writing to contact@edustick.eu from the email address given in the Order. Cancellation stops further renewals. Access Codes issued for paid periods remain valid and an open Access Window runs until its end. Cancellation does not by itself refund the price of a paid period, subject to paragraphs 9–12 and § 11.
- Right of withdrawal. A Consumer or an Entrepreneur with consumer rights may withdraw from the Subscription agreement within 14 days of its conclusion without giving reasons, in accordance with § 10. As long as the Access Code has not been used, withdrawal is unconditional: the Seller refunds the full price paid and the Access Code is cancelled.
- Consent to performance before the withdrawal period ends. An Access Code can be entered on the Website before the withdrawal period ends only after the Consumer gives prior express consent to performance starting before that period ends and acknowledges that they will lose the right of withdrawal once performance has begun. Consent is collected on the Website through a separate checkbox, not ticked by default, before the Access Code is used. The Seller promptly confirms the consent and the acknowledgement to the Consumer by email (on a durable medium). A Consumer who does not give consent may use the Access Code after the withdrawal period ends.
- Loss of the right of withdrawal. Once the Access Code has been used on the terms of paragraph 10, the right of withdrawal no longer applies to the period for which that Code was issued (Article 38(1)(13) of the Polish Consumer Rights Act).
- Withdrawal on renewal. On each automatic renewal, a Consumer or an Entrepreneur with consumer rights may withdraw from the agreement with respect to the renewed period within 14 days of the renewal charge, provided the Access Code issued for that period has not been used (activated) on the Website. The Seller then refunds the full amount charged and the Access Code is cancelled. Paragraphs 10 and 11 apply accordingly to the Access Code issued for the renewed period. A withdrawal statement does not cancel the Subscription unless the Customer requests so.
- Failed payment. If a renewal payment cannot be collected, the Seller retries the charge three times, every 7 days, and asks the Customer by email to update the payment method. Until the payment is credited, no further Access Code is issued; an Access Window already open is not affected. After the third failed attempt the Subscription is cancelled and the Seller notifies the Customer by email.
- Price changes. The Seller may change the price of future billing periods for important reasons, in particular changes in the cost of providing the service, changes in law or tax rates, notifying the Customer by email at least 14 days before the change takes effect. A Customer who does not accept the change may cancel the Subscription before that date. A price change never applies to periods already paid for.
- Discontinuation. If the Creators Club is discontinued, the Seller notifies Customers at least 30 days in advance, stops renewals and refunds the price of unused Access Codes and a proportionate part of the price for the unused part of open Access Windows.
- Proof of purchase. The Seller issues proof of purchase (receipt or invoice) for each paid period.
- Related documents. Detailed Subscription rules are set out in the Creators Club Subscription Policy and the rules for using the Website in the Website Terms. In case of conflict on conclusion of the agreement, payment, withdrawal and refunds, these Terms prevail.
§ 10. Right of Withdrawal
- A Consumer or an Entrepreneur with consumer rights may withdraw from the Sales Agreement within 14 days without giving any reason.
- The period referred to in paragraph 1 begins on the day the Product is delivered to the Consumer or to a person other than a carrier designated by the Consumer. For contracts for the supply of digital content or the provision of services, including the Creators Club Subscription, the period begins on the day the contract is concluded.
- In the case of an Agreement covering multiple Products delivered separately, in batches, or in parts, the period referred to in paragraph 1 begins on delivery of the last item, batch, or part.
- In the case of an Agreement consisting of regular delivery of Products for a fixed period (subscription), the period referred to in paragraph 1 begins on taking possession of the first item.
- The Consumer may withdraw from the Agreement by submitting a statement of withdrawal to the Seller. To meet the deadline, it is sufficient for the Consumer to send the statement before the deadline expires. The Consumer may use the model withdrawal form at the end of these Terms, but is not obliged to do so.
- If the statement is sent by the Consumer electronically, the Seller will promptly send the Consumer a confirmation of receipt of the withdrawal statement to the email address provided.
-
Consequences of withdrawal:
- 1) Upon withdrawal from a Distance Contract, the Contract is deemed not to have been concluded.
- 2) Upon withdrawal, the Seller shall promptly (no later than within 14 days of receiving the Consumer's withdrawal statement) refund all payments made by the Consumer, including delivery costs, except for additional costs arising from the Consumer's choice of a delivery method other than the cheapest standard delivery method offered by the Seller.
- 3) The Seller will refund payment using the same payment methods used by the Consumer in the original transaction, unless the Consumer expressly agrees to a different solution that involves no costs for them.
- 4) The Seller may withhold the refund until the Product is returned, or until proof of return is provided, whichever occurs first.
- 5) The Consumer should send the Product back to the Seller's address indicated in these Terms promptly, no later than 14 days from the day on which they notified the Seller of withdrawal. The deadline is met if the Consumer sends the Product before this period expires.
- 6) The Consumer bears the direct costs of returning the Product, including the cost of return if, due to its nature, the Product cannot be returned by ordinary postal means.
- 7) The Consumer is liable only for any reduction in the value of the Product resulting from use beyond what was necessary to ascertain its nature, characteristics, and functioning.
- Where, due to the nature of the Product, it cannot be returned by ordinary post, information about this and about return costs will be provided in the Product description in the Store.
-
The right of withdrawal from a distance contract does not apply to Agreements:
- 1) Where the subject is a non-prefabricated item manufactured to the Consumer's specifications or serving to meet their individualised needs;
- 2) Where the subject is delivered in a sealed package that cannot be returned after opening for health protection or hygiene reasons, if the package was opened after delivery;
- 3) Where the subject is a perishable item or one with a short shelf life;
- 4) For the provision of services for which the Consumer is obliged to pay, if the Seller has fully performed the service with the Consumer's prior express consent, the Consumer was informed before performance began that they would lose the right of withdrawal once the Seller has performed, and acknowledged this;
- 5) Where the price or remuneration depends on fluctuations in the financial market over which the Seller has no control, which may occur before the withdrawal deadline expires;
- 6) Where the subject is items which, after delivery, are inseparably combined with other items due to their nature;
- 7) Where the subject is alcoholic beverages whose price was agreed at the conclusion of the sales contract, delivery of which can only take place after 30 days, and whose value depends on market fluctuations over which the Seller has no control;
- 8) Where the subject is sound or visual recordings or computer software delivered in sealed packaging, if the packaging was opened after delivery;
- 9) For the delivery of newspapers, periodicals, or magazines, except for subscription contracts;
- 10) For the supply of digital content not supplied on a tangible medium for which the Consumer is obliged to pay, if the Seller has begun performance with the Consumer's prior express consent, the Consumer was informed before performance began that they would lose the right of withdrawal once the Seller has performed, acknowledged this, and the Seller has provided the confirmation referred to in Article 15(1)–(2) or Article 21(1) of the Polish Consumer Rights Act.
- Specific rules on withdrawal from the Creators Club Subscription, including on renewal, are set out in § 9a(9)–(12).
§ 11. Conformity with the Contract and Complaints
- The Sales Agreement covers new Products. The Seller is obliged to deliver a Product that conforms to the contract.
- The Seller is liable to Consumers and Entrepreneurs with consumer rights for the conformity of the Product with the contract under Chapter 5a of the Polish Consumer Rights Act of 30 May 2014 (goods) and Chapter 5b of that Act (digital content and digital services, including the Creators Club). If the goods do not conform to the contract, the Consumer may request repair or replacement and, in the cases provided for by law, declare a price reduction or withdraw from the contract.
- For Customers who are neither Consumers nor Entrepreneurs with consumer rights, the Seller's statutory warranty liability is governed by the Polish Civil Code.
- Complaints should be submitted in writing or electronically to the Seller's addresses specified in these Terms, or using the electronic complaint form made available by the Seller on a Store subpage.
- It is recommended that the complaint include: a concise description of the defect, the circumstances (including the date) of its occurrence, the data of the Customer filing the complaint, and the Customer's demand in connection with the defect.
- The Seller will respond to the complaint promptly, no later than within 14 days if the Customer is a Consumer. If the Customer is a Consumer and the Seller does not respond within 14 days, the Customer's demand is deemed accepted as justified.
- Goods returned under the complaint procedure should be sent to the address indicated in § 3 of these Terms.
- Where a Product is covered by a warranty, information about it and its content will be included in the Product description in the Store.
§ 12. Out-of-Court Dispute Resolution
- Detailed information on the Consumer's options for out-of-court complaint resolution and claim enforcement, and the rules for accessing these procedures, is available at the offices and on the websites of district (municipal) consumer ombudsmen, social organisations whose statutory tasks include consumer protection, Provincial Trade Inspectorates, and at the following addresses of the Polish Office of Competition and Consumer Protection (UOKiK):
- The Consumer has the following example options for out-of-court complaint resolution and claim enforcement:
- 1) The Consumer is entitled to apply to a permanent amicable consumer court referred to in Article 37 of the Polish Trade Inspection Act of 15 December 2000, requesting resolution of a dispute arising from an Agreement with the Seller.
- 2) The Consumer is entitled to apply to the provincial trade inspector, in accordance with Article 36 of the Polish Trade Inspection Act of 15 December 2000, requesting initiation of mediation proceedings for amicable resolution of a dispute between the Consumer and the Seller.
- 3) The Consumer may obtain free assistance in resolving a dispute with the Seller from a district (municipal) consumer ombudsman or a social organisation whose statutory tasks include consumer protection (including the Polish Consumer Federation and the Association of Polish Consumers).
- Use of out-of-court complaint and redress procedures is voluntary for both parties. The Seller does not undertake to participate in such proceedings.
§ 13. Personal Data in the Online Store
- The controller of the personal data of Customers collected through the online store is the Seller.
- The personal data of Customers collected by the controller through the online store is processed for the purpose of performing the Sales Agreement and, if the Customer consents, also for marketing purposes.
- Recipients of Customers' personal data include in particular carriers, payment operators, providers of the Shopify platform and Store apps, analytics and advertising providers and providers of the Website. The full list of recipients and information on transfers outside the European Economic Area are set out in the Privacy Policy.
- The Customer has the rights set out in the Privacy Policy, including the rights of access, rectification, erasure, restriction of processing, portability, objection and withdrawal of consent.
- Providing personal data is voluntary; however, failure to provide the personal data specified in these Terms as necessary to conclude a Sales Agreement results in the inability to conclude such an agreement.
For full details on personal data processing, see the Privacy Policy, common to the Store and the Website (the same text is available at edustick.eu/prywatnosc/).
§ 14. Final Provisions
- Agreements concluded through the online store are concluded in Polish or English, according to the language version of the Store selected by the Customer when placing the Order.
- The Seller reserves the right to amend these Terms for important reasons (i.e. changes in legislation, changes in payment or delivery methods) to the extent that such changes affect the implementation of these Terms. The Seller will notify the Customer of each change at least 14 days in advance. A Customer with an active Subscription who does not accept the change may cancel it before the change takes effect.
- In matters not regulated by these Terms, generally applicable provisions of Polish law apply, in particular: the Civil Code, the Act on Providing Services by Electronic Means, the Consumer Rights Act, and Regulation (EU) 2016/679 (GDPR).
- The Customer has the right to use out-of-court complaint and redress procedures, in particular by contacting the district (municipal) consumer ombudsman.
- For the Creators Club, the Creators Club Subscription Policy and the Website Terms (edustick.eu/regulamin/) form an integral part of these Terms.
- These Terms apply from 1 October 2026. Agreements concluded before this version was published remain governed by the previous terms, unless the provisions of this version are more favourable to the Customer.
